As noted in the Forbes article by William P. Barrett, From The Grave, Tax Lawyer To Rich Beats IRS Again, the memorable Chicago tax lawyer Burton W. Kanter continues to win case after case against the Internal Revenue Service even after death.
Kanter was one of the leading tax attorneys in the United States and senior editor of the Journal of Taxation. He is famous for escaping years of his own federal income taxes and for providing tax relief to Hollywood bigwigs and multi-million dollar families such as the Pritzkers.
Kanter offered major tax relief to the Pritzker family. He negotiated an offer in compromise that allowed them to pay the IRS $9 million instead of the $150 million the IRS sought. But the fight isn’t over yet. Kanter’s estate is combating yet another IRS tax lien on the $165,000 profit made from the sale of a condo previously owned by Kanter’s late wife, Naomi. It seems like the accusations of tax fraud and numerous IRS audits seem to be never ending for Kanter.

Kay Bell is a native Texan, professional journalist and self-proclaimed tax geek. She says the Don’t Mess With Taxes blog aims to “Keep Uncle Sam cranky by providing tax and personal finance tips and advice that will put more money in your bank account, not the government treasury.”
She recently wrote about the recent legislative debate in Congress about the American Jobs and Closing Tax Loopholes Act of 2010 (HR 4213). The bill has passed in the House on May 28, 2010, and now goes before the Senate.
Bell spent 20 years as Congressional staff in D.C. and in the private sector. She’s the author of the book “The Truth About Paying Fewer Taxes” which discusses the ways tax code can be used to benefit individuals who are filing. Bell says her forte is “translating difficult subject matter into lively, readable copy.” It’s no wonder that her tax information blog has been named one of the Internet’s best tax sites!

Many Americans have back taxes and interest that they would like to resolve but are scared that they may not be able to pay the large amount owed. We see this all the time at Tax Resolution Services. Question: I owe a significant amount in back taxes and interest. What’s the best option for me — an Offer in Compromise or an Installment Agreement?
Answer: I wish it were as simple as saying one option is better than the other. But that’s impossible to say. The truth is, the Offer in Compromise and Installment Agreement are both excellent programs suited for specific and different circumstances.
The first thing you should do is determine your current circumstances. The best way to do this is by consulting with a qualified tax professional who will analyze your previous returns and your current financial situation. From this information, you and your tax professional can begin to assess whether the Offer in Compromise or the Installment Agreement would be your better option.
Let me briefly explain the differences between the two programs.
The Offer in Compromise is geared to taxpayers who owe a significant amount of money to the IRS but who, for whatever reason, are unable to pay this debt, even over time. This may be due to a failed business, medical expenses, legal judgments, personal misfortune, etc. The point is, for taxpayers who cannot pay their debt, the IRS allows the taxpayer to make an offer that would settle that debt once and for all. Oftentimes, this offer amounts to a substantial discount. You and your qualified tax professional meet with the IRS and then present your offer. It’s that simple.
By contrast, the Installment Agreement (also known as an IRS Payment Plan) is intended for taxpayers with debt who are unable to pay the debt off in one lump sum but who have the resources to pay the debt down over time. Under the program, the taxpayer makes monthly payments that will over time eliminate the tax debt. Think of this like a car payment — paying a small amount regularly to pay off a large amount in time.

Does your company use a call center to handle customer or technical service calls? Is your contracted call center located outside of the United States? If so, you should pay close attention proposed legislation by United State Senator Charles E. Schumer. According to the recent bill proposal, a $0.25 per-call excise tax will be imposed on companies who transfer domestic customer service calls to call centers outside of the United States.
US companies need to be prepared to pay the new tax if/when the legislation passes. Businesses are the largest source of uncollected taxes and with the recent economic crisis, tax authorities at both the federal and states levels are pouring more money and personnel into cracking down on businesses – large and small – to cut into their growing budget deficits. In fact, 25% to 30% of my tax relief clients are small businesses with tax problems.
Schumer’s legislation would require companies to disclose with their callers what country their call is transferred outside of the US, as well as track and report their use of foreign call centers quarterly and annually. The Federal Trade Commission (FTC) is getting involved as well: companies will be required to annually report to the FTC that they are complying with this legislation, and failure to comply would result in civil penalties.
Companies tend to contract overseas call centers (most commonly in Canada, India, Indonesia, Ireland, the Phillipines and South Africa) because of the high-volume of English-speaking people who are willing to work for low wages. This proposed bill will encourage companies to keep their call centers in our country, therefore providing people with jobs.
Because new tax laws like Schumer’s are being added frequently, it is important for anyone planning to start and/or grow their business to know how to avoid tax trouble by staying up to date with new tax laws and understanding the implications for their company. This Saturday, June 5th 2010, the IRS will be holding a second round of open houses aimed at assisting both individual taxpayers and small business owners with:
filing tax returns (2009 and prior years)
resolving tax problems
setting up payment arrangements
To find your local IRS Taxpayer Assistance Center check the IRS website. It is important to keep in mind this tax preparation service is available by the IRS for individual taxpayers who’s income is less than $49,000.
It is also important to keep in mind that these open houses allow taxpayers to work directly with the IRS, though this is not always the best option for taxpayers who are seeking serious IRS tax help. IRS enforcement is on the rise. And while this opportunity will allow you to seek tax help from the IRS, in some cases you may need to disclose your financial information to the IRS which could land you in more trouble than when you started.
While the extra IRS tax help could be good for taxpayers, if you owe back taxes, it is strongly recommended you seek expert tax help from a tax attorney, CPA, or Certified Tax Resolution Specialist before you speak to the IRS. Re-arranging your Saturday plans to include a quick visit to your local IRS open house may seem like a convenient solution, but in many instances this is like going to court without a licensed attorney – not a wise move.

The IRS is at it again. The stealthy and highly aggressive agency has added two new 1099 tax forms for businesses, requiring extra caution and countless more hours in reporting and preparing your tax returns. This means all business, no matter how small, will be affected. Whether big or small, it is essential to be aware of these new tax extensions NOW– or you could find yourself in BIG trouble when filing your tax return next year.
Additionally, we can expect the number of IRS audits to continue to rise for small-business owners in 2010. About 25% to 30% of my tax relief clients are small businesses with tax problems – so I know how important it is to avoid IRS penalties, IRS audits or other tax problems that could be detrimental to your business.
Neil deMause revealed in his CNNMoney.com article “Stealth IRS changes mean millions of new tax forms” these two new tax extensions:
1) 1099-K – an extension to the 1099 form, which requires businesses to report non-wage income (dividends, earned interest, contract work). The 1099-K addresses “hard –to-track” payment streams used by businesses: credit cards. From 2011, businesses making over 200 payment transactions per year (and totaling over $20,000) through credit or debit cards have to fill out the 1099-K, documenting the year’s transactions and send this to their clients and the IRS. This will have little effect on companies currently reporting all credit card transactions to the IRS, though if you are not currently in the practice of doing so, it’ll be worth it to anticipate this for the near future.
2) 1099-Misc – used by companies use to record payments to individual service providers and freelance workers, has been massively expanded to include, from 2012, all annual business payments and purchases over $600. While previously payments to corporations and purchases of goods have been excluded, now all businesses need to obtain the taxpayer ID number of firm or individual you are paying. This form will now be a tracking mechanism used for any and all business transactions.
What This Means For Your Business: Swimming in Paperwork and Receipts!
The simple truth is that these extensions to tax legislation are quite the burden. There is a high probability you may get lost in the paperwork and tracking of receipts. A small business currently spends 3 – 5 hours a year on average filing 1099 forms. A survey conducted by Pennsylvania-based SMC Business Councils, shows that filing these two 1099 extensions for services purchased from corporations only would cause a standard small business at least 200 filings per year and an additional cost of $6,000 in preparing yearly tax returns. This estimate excludes the requirement for filing 1099s for purchases of goods – this would cause a staggering increase.
How did this tax provision blizzard come upon us? This new legislation has been in the works since 2007 when a tax-gap study was conducted. This ‘tax gap’ between businesses and individuals costs the government about $300 billion per year in lost revenue. The study showed that adding additional 1099 tax extension forms could produce $345 billion per year in federal tax revenue and this is where the health reform bill comes into play. These two extension requirements are part of the health reform bill – snuck in the 2,000+ page bill, allowing the government to track down unreported income. The goal of this new tax legislation is to catch income that is not currently reported to the IRS.

Every day, in cities across the country, people are being prosecuted or convicted of tax crimes. Brenda Ellis kept the books, and every day her husband Thomas would bring home the money to be counted, she tallied the cash in two registers — one showing the actual revenue, the other showing the revenue they intended to declare. The Ellises then deposited into the bank only as much money as they intended to declare, keeping the off-the-books income in cash to be used on personal expenses.
Untraceable, right? No way to be caught. Wrong. The IRS the most aggressive agency on the planet – they are always watching.
Thomas and Brenda Ellis pleaded guilty to conspiring to defraud the IRS of more than $133,000 in tax revenue. They face five years in prison and a fine of up to $250,000. But the Ellises’ case isn’t an isolated one — and that’s the point. There are many Americans just like them who cheated on taxes only to be caught, prosecuted and in many cases jailed.

Take some other cases, for example. Earlier this year, Iowa businessman Keith Chapman received three and a half years in prison after committing bankruptcy fraud and filing false tax returns. Or look at the case of John A. Gullett, of Parkland, Fla. He received more than four years in prison after failing to report about $3 million income. Like the Ellises, he apparently thought the IRS would have no way of tracing his income. And also like the Ellises, he was wrong.

Terri Lynn Lucero, 50, of Alamosa, Colo., pleaded guilty to filing a false tax return. Lucero was an employee at the Housing Authority of Alamosa. From 2001 to 2004, she prepared 96 checks payable to Steve Lucero. Some of the checks were for work she and Steve Lucero did, but most represented embezzled money. The total was $168,949. All of the money should have been reported, but was not. Lucero faces up to three years in prison and a fine of up to $100,000.
