According to the recent article on TheStreet.com “IRS to Expand Audits as Cash Runs Low” by Joe Mont, it appears the IRS is doing anything and everything they can to make up for the “estimated $14 billion that companies underpay in employer taxes a year.” The IRS plans to execute a three-year campaign that will crackdown on 6,000 businesses. No one is safe from IRS audits as Uncle Sam zeros in on randomly selected companies and individuals in order to take back what he’s owed.
Mont discusses the biggest challenge the IRS will face while undergoing thousands of audits: “defining who is, or isn’t, an employee.” They realize that many companies will misclassify employees in order to bypass protections. The agency plans to scrutinize both big and small companies to guarantee they’re catching as many misclassified employees as possible with these “worker misclassification audits”.
In a 1984 IRS assessment of misclassification the agency found that “15% of employers misclassified 3.4 million workers.” They’ve already stated their plans to put IRS bank levies on large financial firms that receive bailouts, now they’re going to zero in on individual taxpayers. The IRS is prepared to do whatever it takes to collect every penny missing from the government bank account.

A Huntington Beach, Calif., man who sold videotapes and books that promoted his strategy to use corporations to conceal personal income has pleaded guilty to using his corporations to hide income from federal tax authorities.
Dana Ray Reynolds pleaded guilty to two counts of subscribing to false tax returns for the years 2002 and 2003 and admitted that he failed to report more than $300,000 in income to the IRS in each of the years.
Reynolds, who promoted his tax-avoidance strategy through companies such as Repackaging America and Incorporating You used these companies to pay personal and family expenses. Reynolds also used the corporations to conceal assets, such as automobiles, recreational vehicles and at least one vacation home. Reynolds did not report the money taken from the corporations as income, causing tax losses of more than $80,000 to the IRS.
“To market his concealment and avoidance strategies, Mr. Reynolds highlighted his own elaborate lifestyle made possible by following the plans he developed. Now, Mr. Reynolds faces federal prison for having subscribed to false tax returns and his own misguided marketing,” said Leslie P. DeMarco, Special Agent in Charge of IRS Criminal Investigation’s Los Angeles Field Office, in a statement. Reynolds faces up to six years in prison.

A married couple in Portland, Ore., was convicted of nine counts of criminal tax violations spanning 10 years for their sale and promotion of abusive tax shelters.
Micaela Renee Dutson, 48, and Tony Dutson, 53, were convicted of conspiring to defraud the IRS, obstructing the IRS, causing clients to use bogus financial instruments in an attempt to pay their taxes, failing to file tax returns, and aiding and advising a client to file a false tax return. In all, according to the government, the Dutsons helped to defraud the IRS of approximately $7 million.
Micaela Dutson was a lawyer, and the couple used her law office in Tigard, Ore., to promote and sell abusive tax trusts for several years before moving to Arizona in 2003. The couple made more than $1 million dollars from the scheme and paid no income tax. The Dutsons also filed approximately 30 bogus tax returns, attempting to claim fraudulent refunds from the IRS totaling more than $185 million.

I got an interesting email recently regarding the new health care law (see below for full email message) . The email FALSELY claims that the new legislation would require workers to pay income tax on the value of employer-provided health insurance. This is simply not the case.
It’s true that the value of employer-paid health insurance will be added to employees’ W-2 forms for information purposes, however, contrary to this widely circulating chain e-mail, it definitely will be considered taxable income.
There’s a great article on Snopes.com that talks about this further. Basically, H.R. 3590 imposes a 40% excise tax on the value of employer-sponsored medical insurance that exceeds a give threshold. This will be paid be the insurance company, not the employee and is initially expected to affect fewer than 10% of the families covered by health insurance

There is alot of confusion about the new health care law and the evolving tax code in general. What’s important to keep in mind is that there are still more tax hikes planned for 2010 intended to fund healthcare reform. So you want to get the facts and stay up to date on any legislative changes that could affect you. Here is the email that has been circulating and FALSELY claiming that the new health care law would require workers to pay tax on the value of employer-provided health insurance:
I contacted my Congressman about House Bill HR3590 the health care bill that just passed. I asked for a summary of changes. The aid directed me to go to www.thomas.gov <http://www.thomas.gov/> , enter HR3590 in the search box and look for CRS Summaries. Then scroll down to:
TITLE IX REVENUE PROVISIONS- SUBTITLE A: REVENUE OFFSET PROVISIONS-(Sec.9001, (as modified by sec.10901) Sec.9002.
Starting in 2011 (next year folks) your W2 tax form sent by your employer will be increased to show the value of whatever health insurance you are given by the company. It does not matter if that’s a private company or government body of some sort. If you’re retired….So what, your gross will go up by the amount of insurance you get.
The dollar value (cost of what the company pays for your insurance) will be considered income and added to your gross pay. You will be taxed on the total.
You will be required to pay taxes on a larger sum of money that you have never seen.
Take your tax form you just finished and see what $15,000 or $20,000 of additional gross income does to your tax debt. That’s what you’ll pay next year. For many it also puts you into a higher tax bracket so it’s even worse.
This is how the government is going to buy insurance for 15% of the populace that doesn’t have insurance and it’s only part of the tax increases.
Not believing this, I researched the summaries and here’s what I’m reading:

TITLE IX REVENUE PROVISIONS- SUBTITLE A: REVENUE OFFSET PROVISIONS-(Sec.9001, (as modified by sec.10901) Sec.9002. “requires employers to include in the W2 form of each employee the aggregate cost of applicable employer sponsored group health coverage that is excludable from the employees gross income.”

After the deal almost fell apart, the Swiss parliament and Swiss bank UBS agree to provide data to the IRS, finally collapsing the world’s most famous tax shelter.
With an historic deal on the brink of collapse, the Swiss parliament has approved the release of banking data to the Internal Revenue Service.
The deal, brokered in the wake of a Department of Justice investigation of Swiss banking giant UBS, pierces the Swiss banking veil and destroys a tax shelter so famous it has become a common pop-culture reference.
Now, UBS is in position to release the details of 4,450 offshore account holders suspected of evading U.S. income taxes.
For UBS, the decision to release the data came with significant arm-twisting from the U.S. government. In February 2009, UBS agreed to pay the U.S. government $780 million in order to put an end to criminal charges alleging the bank helped U.S. clients evade taxes.
For U.S. taxpayers engaged in tax evasion, the agreement with UBS and the Swiss government should come as startling news.
What was once considered an impenetrable veil — a tax shelter so strong it had survived two World Wars and an international banking crisis — is no more.
The IRS will soon obtain data and information on U.S. taxpayers who have evaded taxes for years, even decades. So if you have delinquent tax returns, this concerns you.
While it’s true that Swiss banks tended to be the tax shelter of choice for the wealthiest of U.S. taxpayers, the UBS deal is just as important to those evading taxes through other means.
In short, the U.S. government’s success in piercing the Swiss banking veil should prove finally that no tax shelter is safe.
Indeed, previous actions from the IRS support that conclusion.
Before the Swiss agreement, the U.S. government brokered a deal with the major credit card companies to provide information on clients who were linking their credit cards to offshore bank accounts, primarily in the Caribbean. At the time, a common tax-avoidance scheme was to funnel money into a Caribbean account, then use it to pay credit card bills full of purchases made in the United States.
The tax evaders who employed this scheme either came forward during the amnesty period or were prosecuted, just as the UBS account holders likely will be.
With a record deficit and a slow economic recovery, the federal government has made tax collection and enforcement a top priority. This year, the U.S. Congress approved a record $5.5 billion enforcement budget for the IRS.
That means the IRS will have even more agents this year to audit taxpayers and investigate tax cheats — part of a three-year trend of putting more revenue officers on the streets.
So let’s summarize:
The IRS stopped the use of credit cards linked to offshore accounts.
The U.S. Department of Justice pierced the Swiss banking veil.

I recently read an article on CNNMoney.com written by Beth Braverman titled “5 things to know about getting audited.” I am always looking for helpful resources for my readers, so I wanted to share this IRS tax relief advice with you. Here is a quick summary of the 5 tips discussed in the article.
1. Audits are on the rise
After filing your taxes, there’s always reason to wonder: Will the taxman come knocking? Well, the answer is maybe. The number of IRS tax audits increases every year. According to Braverman’s article “experts expect that trend to continue, what with the ballooning federal deficit and the additional $400 million earmarked for tax enforcement in 2010.” The IRS is constantly looking for ways to crack down on delinquent taxpayers. If you get audited this year it is likely due to your 2008 taxes because audit letters are usually delivered 18 months after the filing date.
2. Delaying can cost you the right to fight
I’ve talked about procrastination again and again. If you find yourself in trouble with Uncle Sam, it is important to take immediate action. You usually have 30 days after receiving your first notice to respond, otherwise you could be facing serious penalties from the collections department.
As mentioned in the article, if you can’t get your act together in 30 days “You have the right to ask for a postponement, and the IRS should grant such a request if you say you need the time to track down records.”

TheStreet.com reports the IRS estimates U.S. companies underpay employer taxes by over $14 billion a year. Take for example the case of a residential foundation repair corporation. The corporation filed its necessary 1099 forms (showing payments to its workers) once the IRS assessed the taxes. However, as the IRS assessment was wrong and the corporation filed the necessary forms after the assessment, and not before, the corporation was disallowed in raising section 530 safe harbor as a defense before a federal district court. This failure to file the correct tax forms on time, in effect constitutes the IRS assessment as correct when made.

The IRS’s failure to comply with the section 530(e)(1) notice procedures did not warrant a reversal of the burden of proof. The corporation was informed at the conclusion of the audit that the IRS had determined that the section 530 safe harbor did not apply. The corporation had sufficient opportunity to seek administrative relief with respect to that determination. The district court also properly found that the corporation’s workers were its employees, not independent contractors, for federal employment tax purposes. The corporation retained a significant level of control over its workers’ schedules and ability to perform foundation repair jobs, the workers had no risk of loss, did not invest in facilities and were not in business for themselves.
