Robert L. Braddy Jr., 39, of College Park, Ga., was sentenced to two years and six months in prison for income tax evasion. He was also ordered to pay $306,906 in restitution.

Braddy was immediately remanded to the custody of the U.S. Marshals Service at the conclusion of the sentencing hearing.

According to court records, when Braddy filed his 2003, 2004 and 2005 federal income tax returns, he willfully attempted to evade a large part of the income tax he owed the United States by filing a false and fraudulent U.S. Individual Income Tax Return (Form 1040).

For each of the returns he filed, he knew that his total income and the tax due and owing substantially exceeded the amounts he reported.

Braddy under reported his income by more than $1.1 million and underpaid his income taxes by $306,906

“This defendant hid $1 million in income and cheated his fellow citizens who pay their fair share of taxes. Now he is going to prison,” said United States Attorney Sally Quillian Yates in a statement.

Braddy is not eligible for parole.

Tax Relief FAQ: What Is An IRS Installment Agreement for Payment of Back Taxes?

Thousands of Americans owe back taxes and interest to the IRS every year. If you are one of the many taxpayers feeling the burden of tax debt, it’s important to take the necessary steps to resolve your IRS problems now – and not later. The worst thing you can do is ignore letters from the IRS in hope that your troubles will go away. They will not, unless you take the appropriate steps!

If you have back taxes to settle, it’s important to know what options are available to you for dealing with the IRS – so you can get the income tax relief you need. If you are unable to pay off back taxes in full, you may qualify for tax relief by negotiating an IRS Payment Plan, more commonly known as an Installment Agreement (IA).

An Installment Agreement allows taxpayers to pay off tax debt with a series of regular monthly payments, usually within a statutory five-year timeframe. Once an Installment Agreement is established, the IRS will cease all collection actions, including garnishment of wages. If the amount the taxpayer can afford to pay monthly does not satisfy the debt owed (including interest and penalties), another tax relief option, such as a Partial Pay Installment Agreement or an Offer in Compromise, may be a better choice. With the economy being low, tax scams are abundant these days.  When I came across this question from a taxpayer, I thought it was important to address this.  Many people are confused about why the IRS Offer in Compromise program was created and my answer below should satisfy you.

Question: I’ve read some of what you’ve said about the Offer in Compromise program. To be honest, I find it hard to believe. There are so many scams out there. I owe a good deal of money in back taxes, and I don’t know how I’ll pay it off. But why would the IRS agree to accept less than I owe?

Answer:  Your skepticism is healthy. Indeed, there are a lot of scams out there today — many of them preying on people in tax trouble — and so you are wise to take a skeptical approach at first.

But I — and every other qualified tax professional out there — can assure you that the Offer in Compromise is not a scam. To understand why the IRS might be willing to accept less than you owe as part of a compromise offer, it’s important to understand the IRS’s position and mentality: Prior to use of the Offer in Compromise, the IRS often took a tough-as-nails approach with indebted taxpayers — knocking on doors, chasing taxpayers across the country, trying everything to collect what was owed.

During this period, the IRS began to realize that a gentler approach could actually be more effective. The irony is that the Offer in Compromise in many ways allows the IRS to collect more tax revenue than the more aggressive tactics netted. That’s exactly why the tax-collecting agency might be willing to accept less than you owe as part of a compromise offer.

Now, if you’re interested in filing an Offer in Compromise, the first thing you should do is consult a qualified tax professional. He or she will analyze your previous returns, establish the exact amount of your tax debt, and chart a course of action. Of course, you need to make sure you qualify for the Offer in Compromise program, and this is where you’re qualified tax professional can help. Tax Relief FAQ: How Does “Currently Not Collectible” Status Affect IRS Collection of Back Taxes?

Owing back taxes and interest to the IRS is a surprisingly common problem: thousands of Americans feel the burden of it every year. Therefore it is important to take the steps to resolve your IRS problems now. The worst thing you can do is ignore letters from the IRS, hoping your troubles will go away. They will not do so on their own – you must take the appropriate steps! If you have back taxes to settle, it’s important to know your options for dealing with the IRS so you can get the income tax relief you need.

If you owe back taxes but are not able to pay anything at all as a monthly installment, or you can’t get to the equity in your assets (if you have any) one option to consider for obtaining tax relief is having your account declared “currently not collectible” (CNC) by the IRS. The IRS often refers to this as a “hardship” status and the taxpayer must present incontrovertible evidence that he or she has no ability to pay the back taxes owed at the present time.

This evidence is submitted through IRS Form 433-F, (or Form 433-A if the debt is considered substantial) the Collection Information Statement (CIS), which details income, assets, and expense information. Any taxpayer who contemplates this tax relief option should immediately seek tax help from a tax attorney or Certified Tax Resolution Expert who is best able to advise whether this is the proper option and, if so, can expertly prepare the CIS.

CNC status is considered on an individual basis. In the right circumstances, CNC can indeed provide tax relief breathing room. For example, even if the CIS does show that there are assets or income that potentially could be levied, the IRS may exercise “reasonable forbearance” if the collection of those assets deprives a taxpayer from essential living expenses. Factors such as health and age may also be considered.

While this declaration does temporarily suspend collection action by the IRS, it is important to understand that it does not forgive the debt. The IRS may still file a tax lien on future assets before it declares any account CNC, and interest and late payment penalties may still accrue. CNC tax relief can last the full 10-year term before the Collection Statute Expiration Date, but the IRS can resume collection action any time before the statutory expiration date. And, if a taxpayer can reasonably pay a minimum of $25 per month, the IRS will require the taxpayer to enter into an installment plan before it will place the account in CNC.

If the IRS declares an account CNC, the taxpayer will receive a Status Code 530, and the decision will be documented on Form 53 (Report of Currently Not Collectible Taxes). If the account is still deemed CNC at the statutory expiration, the IRS cannot further pursue tax debt payment. Remember, you don’t have a CNC agreement until the proper codes (530) are input into your tax transcript by the IRS. The average lay person does not have this knowledge and thinks he/she has a CNC agreement and then unknowingly gets levied. This is why you require expert tax representation by a qualified professional. A Certified Tax Resolution Specialist or specialized tax attorney is best positioned to step in, contact the IRS on your behalf, and work through your individual tax relief plan.

Tax Relief FAQ: You Owe The IRS Back Taxes. What If You Cannot Pay The Full Amount Now?

If you have back taxes to settle, it is essential to know your best options for dealing with the IRS so you can get the income tax relief you need.

If you owe back taxes but have limited, or no, ability to pay at the moment, there are several scenarios in which the IRS will work with you to reach a mutually agreeable solution that provides tax relief:

1) If you cannot pay the entire amount up front, you may be eligible for a monthly installment payment plan designed to pay off the full amount within five years.

2) If you can pay a certain amount per month, but that amount will not pay off the back taxes within five years, you can pursue an Offer in Compromise. With an OIC, the IRS agrees to settle your tax debt for less than the amount you actually owe, requiring a lump-sum payment or a short-term installment plan.

3) If you are unable to pay anything toward your back taxes AND can present evidence of your inability to pay, you may ask the IRS to declare your account “currently not collectible.” If so declared, the IRS agrees to suspend collection activities on the back taxes, including levies and garnishments, for about a year.

Back Taxes Aren’t Your Only Problem When Concealing Income from the IRS

Owing the IRS back taxes can be scary, but ignoring back taxes can be scarier.  Many people (incorrectly) assume that if you owe the IRS back taxes, you will have to come up with the money all at once.  Not true!  There are tax relief options available for those of you that want to settle your back taxes.  These tax relief options, however, are better left up to a tax expert to help you figure out what you qualify for, and how to approach the IRS.  One option is an IRS payment plan, also known as an Installment Agreement, where you can pay the IRS back in reasonable monthly installments over time.  Another option is the Offer in Compromise (OIC) program where you can get your back taxes and penalties reduced due to hardship (this is a program that you must qualify for).  Every US citizen must pay taxes.  When you ignore or evade taxes, and conceal your income to top it off, back taxes become just a small part of your problem.  Prison time, fines and a criminal record become the rest of your problem!

Vincent Mavilia, 67, of Warren, Conn., was sentenced to 18 months in prison, to be followed by three years of supervised release, for evading federal income taxes for more than a decade.  Mavilia was also ordered to pay a $5,000 fine.

According to court documents and statements made in court, Mavilia has owned and operated a number of bars and adult-entertainment businesses.

However, from 1992 to 2003, Mavilia took steps to conceal from the Internal Revenue Service his ownership of the businesses as well as the income he received by placing them in the name of his adult daughter.

Mavilia further attempted to conceal his income from his businesses by using bank accounts in his daughter’s name to deposit funds and make payments of his personal expenses.

Mavilia also purchased and owned real property in Branford, Brookfield and Danbury, but placed the properties in the names of other individuals in order to keep them far from the reach of the IRS.

In addition to his sentence and fine, Mavilia was ordered to pay $359,291.15 in back taxes, penalties and interest.

Thomas Shakespeare, 63, of Avon, Ind., was sentenced to 42 months in prison after pleading guilty to embezzling $583,270 from his employer and multiple counts of tax evasion.

From March 2002 to November 2008, Shakespeare, while working as controller for Advantage Marketing Inc., made fraudulent entries to the business’ payroll systems over this six-and-a-half-year period. These fraudulent entries allowed him to receive higher paychecks on 147 occasions, totaling more than $583,000.

Shakespeare was also convicted of five counts of income tax evasion for the tax years 2003 to 2007. He failed to file income tax returns and failed to pay taxes on the embezzled funds as well as his normal salary.

Shakespeare was also sentenced to serve two years of supervised release following his prison term and ordered him to pay $583,270 in restitution to Advantage Marketing. In addition, Shakespeare will forfeit his home, two cars and more than $40,000 in his retirement account. The amount of forfeited property is estimated to be worth approximately $200,000.

Tax Relief FAQ: You Received a CP-504 Notice From the IRS for Back Taxes You Owe – What Does This Mean?

If you are one of the thousands of Americans who owe back taxes and interest to the IRS, it’s important to take the steps to resolve your IRS problems. The worst thing you can do is ignore letters from the IRS in hopes your troubles will go away. They will not, unless you take the appropriate steps!

If you have back taxes to settle, it’s important to know your best options for dealing with the IRS so you can get the income tax relief you need.

If you owe back taxes to the IRS, you may receive a CP-504 notice. This IRS notice begins with the message “Urgent! We intend to levy Certain Assets.” This threatening tone is meant to compel immediate action on your part, but you need not be frightened into taking immediate steps that could be contrary to your legal interests. The IRS itself admits that it “cannot levy with just this notice.” To levy assets, the IRS must first issue a Notice of Intent to Levy –  it will seek to issue a levy against your state tax refund. It may also search for other assets on which to issue a levy, and may file a Federal Tax Lien.

Keep in mind that the IRS has issued the CP-504 notice because you have not responded to several previous notices for payment of back taxes. The notice may be issued even if you have received “hardship” status, or have already worked out an installment plan, in which case your status needs to be confirmed with the IRS. A separate CP-504 notice may be issued for each tax period in which you owe back taxes. If you do not respond promptly to the CP-504 notice, the formal Notice of Intent to Levy will soon arrive. It’ll be in your best interest to seek tax help before this happens! An expert tax attorney or Certified Tax Resolution Specialist will be able to obtain the necessary relief from the back taxes you owe.

Pay More in Back Taxes, Penalties and Interest by Evading Taxes

I am assuming that most people who evade taxes do so because they want to keep the money all for themselves.  Well, for all of those currently evading taxes, I say enjoy it while it lasts . . . because it won’t last long.  Once the IRS catches up with you, and I am not saying “if” the IRS catches up with you (because they will!), you will not only have to pay the back taxes you owe, but you will get hit with penalties and interest and maybe even prison time.  The gentleman in the article below now has a record and is ordered to pay back much more than half of the income he received for tax evasion.  

David Thomas, 56, Killingworth, Conn., was sentenced to three years of probation for failing to pay taxes on more than $120,000 in income. According to court records, Thomas was retained by the Cedar Island Improvement Association to provide legal assistance. Thomas received $120,977.22 from the association that he then failed to report. Thomas must pay approximately $80,744 in back taxes, penalties and interest.
