Under the new health care mandate, the IRS has authority to withhold a portion of your federal tax return if you can’t demonstrate that you have health insurance coverage.
Starting in 2014, penalties for lacking qualifying coverage will range from $695 to 2.5% of your household income, whichever is greater. According to a recent Fox Business article, Steven T. Miller, IRS Deputy Commissioner for Services and Enforcement, commented that the IRS can reduce a tax refund to collect the penalty.
The article titled “IRS May Withhold Tax Refunds To Enforce Health Insurance Mandate” also stated:
Under the new law, insurance providers will be required to provide a 1099 information return to the taxpayer and the IRS demonstrating that the individual is covered. The IRS will use document matching to identify people without coverage, and will notify those taxpayers that they may owe penalties. …The law doesn’t authorize the IRS to impose liens or levies to collect the penalties. But it doesn’t prevent the IRS from reducing a tax refund to collect the penalty.

A retired FBI Agent has pleaded guilty to evading approximately $109,000 in personal income taxes.
Jan Lindsey, 67, of Henderson, Nev., pleaded guilty to one count of felony tax evasion and is scheduled to be sentenced on Friday, July 9, 2010.
According to the plea agreement, Lindsey worked as an FBI Agent for 26 years and retired from the FBI in 1995. For the next 10 years, Lindsey worked for the FBI as a contractor performing background investigations. Prior to 1999, Lindsey filed tax returns with the IRS.
Beginning in 1999, Lindsey started using illegal tax-avoidance methods to file his and his wife’s joint tax returns. Lindsey failed to file or pay federal income tax for the years 1999 through 2006, and committed various acts that were designed to hide his income and assets from the IRS, including placing assets in nominee names and presenting or recording fraudulent documents in an attempt to obtain lien and levy releases on his property.

Pradeep Bali, 56, of Fresno, Calif., was sentenced to six months in prison for tax evasion. According to prosecutors, Bali is a self-employed real estate agent and co-owner of Realty World Starr and First Continental Mortgage Starr, both in Fresno. Bali pleaded guilty on August 17, 2009, and admitted that he submitted a false tax return for the year 2000. He falsely inflated losses or did not report income to one of his businesses, resulting in a tax loss of $79,000.

In the latest news about tax evasion charges for UBS account holders, five more has just been found guilty for hiding funds overseas.
According to Wall Street Journal, “A number of UBS clients have agreed to plead guilty to criminal charges for failing to report funds held overseas or by overseas entities.”
In many cases, people who know they are facing tax evasion charges will plead guilty for a lesser penalty than risking a longer sentence if they did not plead guilty proactively.

According to evidence presented at trial, Miller worked for a company called Business Administrative Services. Miller attempted to thwart the IRS’s efforts to collect federal income taxes by entering into a “Professional Services Agreement” with BAS, in which he agreed to donate his time to BAS and, in return, BAS agreed to pay his personal expenses. BAS paid Miller’s personal expenses and issued him a preloaded ATM card to pay for personal expenses.

How Innocent Spouse Defense Can Save You
Question: What is Innocent Spouse defense and how can this relieve someone of their joint tax liabilities?
Answer: First and foremost, you can only qualify for Innocent Spouse defense if you’re divorced and signed a joint return for the year in question. Normally, if the husband has a side business with its separate banking account and gets caught for evading his taxes, the IRS can come after both the husband and the wife for the amount owed. If the wife can prove that she 1) did not know about the business and the tax evasion and 2) she did not benefit from the tax evasion of the business (i.e. living a more lavish lifestyle), then she can qualify for Innocent Spouse as long as she is divorced from her husband.
It’s a tricky situation and you definitely want to make sure that you’re going to be mired in IRS trouble for someone else’s mistakes.
What to Do If You’re in IRS Debt
Question: What is your advice for people who are in so much IRS tax debt that they don’t know what to do or where to start?
Answer: There’s a solution to every problem. I have met people who owe the IRS almost $1 million and they’re able to settle an Offer in Compromise agreement with the IRS so that they can pay off their debt in installments. It’s not often that taxpayers end up owing the IRS that much money, but even if you do–you can get tax help to resolve your IRS problems.
It is also important to remember that the IRS is willing to work with you. If you can only afford to pay “X” instead of “Y” per month to resolve your back taxes, they are flexible enough to extend your payment period to accommodate for that. Tax Filing Procrastinators–What to Do Now?
Question: So what if I still haven’t filed my taxes and it’s April 15th in a day? What should I be doing right now?
Answer: If you’re filing an extension, you need to be paying in about 100% of what last year’s tax liability is or you’re going to owe money. What you need to do is sit down with your documents right now, categorize them or divide them by category, not by month, and start doing your tax return.
Remember to review your social security numbers, carefully check them, make sure you didn’t transpose them. Double-check your figures if you’re doing this thing by hand, make sure your arithmetic is correct. Because if it’s not, it will generate a red flag and an IRS audit. Remember to sign and date your return, I cannot believe how many people send in their tax return and don’t sign it. That doesn’t count as a filed return.
Even if you’re filing for an extension, you still need to give the IRS an estimate. So either way, you need to sit down and crunch your numbers. You may as well get the tax return done while you’re at it.
Do I Need to Pay the Alternative Minimum Tax?
Question: What is the alternative minimum tax?
Answer: The short version of alternative minimum tax is if a taxpayer claims too many deductions and ends up having no tax liability, the government will intervene and say “no, you have to pay at least this amount ‘x’”. So you definitely want to be careful with your deductions and make sure that you’re claiming legitimate ones you can prove.

A South Carolina politician faces up to five years in prison after pleading guilty to a tax evasion charge.
Columbia City Councilman Ernest W. Cromartie II, 64, was charged in federal court with a felony information, and at the same time in a plea agreement, he chose to waive the presentation of the information to a grand jury.
Cromartie, the longest-serving city council member in Columbia, is a managing partner in a law firm and owner of One Stop Party Shop. According to federal records, Cromartie did not pay federal taxes and lied about this to investigators.
Specifically, prosecutors alleged he did not pay $25,316 in income taxes in 2004, and his overall actions resulted in a $58,075 tax loss to the United States government.

For those who thought the heat from the UBS-IRS deal has passed, it’s time to think again.
The United States and Switzerland recently announced a new protocol where it will allow the Swiss government to provide information to the IRS on U.S. account holders of Swiss bank UBS.
According to Journal of Accountancy, “The protocol has been approved by the Swiss Federal Council and was signed in Washington on Wednesday, but the deal is still subject to ratification by the Swiss parliament.”
Once ratified, the Swiss government will be able to hand over more names to the IRS to audit and penalize whenever appropriate. The IRS is focusing on finding and penalizing more tax cheats and those who commit tax fraud–namely those who have not provided a W-9 for 3 years or more. This protocol will legalize Swiss cooperation with the IRS to reveal not only those who defraud the IRS, but those who severely cheat on their taxes.

A religious leader in Vancouver, Wash., was sentenced to five months in prison for aiding the preparation of a false tax return.
Until last September, Maximo Garza, 47, was the pastor for Victory Outreach Church of Portland, a non-denominational church which has operated in Portland, Ore., for more than 15 years.
During his plea hearing, Garza admitted he provided false expense invoices which purported to reflect public relations and other services provided by Victory Outreach Church to William Thompson, who was then operating a mail-order divorce service using the name Hallwood Inc. Thompson used the false invoices to take expense deductions on tax returns filed by Hallwood in order to fraudulently reduce his tax liability.
Between 2001 and 2003, Garza provided invoices reflecting a total of $735,441 in false business expenses. Thompson agreed to let Garza keep approximately 10% of the expense amounts.
Thompson pled guilty to tax evasion and was sentenced to a prison term in 2007.

Taxpayers with foreign funds may have felt the heat back last summer when UBS struck a deal with the US government to release some 4,500 names of American bank account holders to the IRS. That frenzy may seem far back in the past now but this wave of aggressive tax evasion crackdown is nowhere near over.
Recently, Wall Street Journal reported that UBS is increasing its lobbying efforts for the Swiss government to reach a deal with the US on how it will deal with confidential bank data. According to WSJ, “The U.S. Internal Revenue Service has uncovered as many as 20 other Swiss private banks as part of a tax amnesty aimed at declaring funds to the authority” and that “UBS argues that a parliamentary no-vote could also harm the other Swiss banks who offered services to wealthy Americans.”
It could be that UBS is trying to get every bank on the same page in terms of how to handle American bank holders’ information. When it comes to working with the IRS, it seems fair that every bank must abide by the same rules. It could also be the case that Swiss banks are trying to ensure that they comply with an agreement with the US so that they can continue to conduct business with American taxpayers and wealthy bank account holders.

Well, embezzling from payroll taxes will land you in prison, like this office manager from Illinois who embezzled from the employee benefit plan and failed to pay employment taxes. She took a gamble that she wouldn’t get caught by the IRS and she lost!
An Illinois woman was sentenced to 30 months in prison as a result of her convictions for tax evasion, willful failure to file federal income tax returns, embezzlement from an employee benefit plan and failure to pay employment taxes.
In addition, Mary R. Storer, 40, formerly of Wood River, Ill., was ordered to serve three years of supervised release and pay restitution in the amount of $266,056 to the victim, Elk Heating and Cooling, and $76,267.29 to the IRS.
The convictions are the result of Storer’s conduct after she was hired by Elk Heating and Sheet Metal as their office manager in 2006. Elk Heating and Sheet Metal is a small, family-owned heating and air-conditioning company in Madison County.
Storer’s responsibilities included answering the telephones, setting up customer appointments and handling accounts receivable and accounts payable. Storer was also in charge of payroll and filing and paying Elk Heating and Sheet Metal’s payroll taxes. Storer immediately began embezzling money from Elk Heating and Sheet Metal and gambled away almost all of the money that she embezzled. At the sentencing, information was also presented that she had gambled heavily in 2007, with losses exceeding $200,000 for that year.

The NYTimes reported a recent case where a wealthy investor in Virginia pleaded guilty to tax evasion charges involving his undisclosed foreign funds. David Thomas, 55, Killingworth, Conn., pleaded guilty to one count of filing a false tax return. Thomas, an attorney, was retained by the Cedar Island Improvement Association to provide legal assistance. Thomas received $120,977 from the association. However, for the tax years 2004 and 2005, he failed to report the $120,977 he received. Thomas faces up to three years in prison and a fine of up to $100,000.

Robert Kahre, the owner of six construction businesses in Las Vegas who paid employees over $100 million in cash wages as part of an elaborate scheme to defraud the IRS, was sentenced to more than 15 years in prison.
“Citizens who pay their fair share of taxes can rest assured that the Department of Justice will continue to utilize all of its resources to prosecute those who choose to cheat and promote fraud,” said John A. DiCicco, Acting Assistant Attorney General of the Justice Department Tax Division, in a statement.
Following an over three-hour sentencing hearing, visiting U.S. District Judge David A. Ezra, of the District of Hawaii, sentenced Robert Kahre to serve 190 months in federal prison, followed by three years of supervised release and ordered him to pay over $16 million in restitution to the IRS. Judge Ezra also ordered that Kahre, who has been free on a personal recognizance bond since he was arrested in 2005, be immediately taken into the custody of the U.S. Marshals Service.
“This kind of conduct is simply not acceptable in the United States,” said U.S. Attorney Daniel Bogden. “Individuals who ignore the federal tax laws by engaging in schemes to defraud in order to enrich themselves at the expense of others will be prosecuted.”
