Tax Help on the Big Biz Show: How to Know if Bankruptcy is a Viable Tax Relief Option

Russ and Sully with the Big Biz Show welcomed back Brian Compton, President of Tax Resolution Services, for more tax relief wisdom – this time about IRS debt and bankruptcy. People are forced to file bankruptcy for different reasons. And I know a lot of folks filed bankruptcy last year because they lost their jobs or they lost their pension.

Bankruptcy is really designed to give people a fresh start, people who have had a catastrophic life event that then causes their financial world to fall off a cliff. So the idea of bankruptcy – some people think, “oh people are trying to sneak around the system” but the purpose is to level the playing field so you can permanently resolve your tax problems once and for all.

Most taxpayers don’t realize that IRS tax debt may be eligible for discharge in bankruptcy. Sometimes bankruptcy is the most appropriate course of action when you have a big tax problem. And other times it’s not- and something like the Offer in Compromise program may be a much better option than bankruptcy.

Bankruptcy does not always remove all tax liabilities as not all IRS taxes, penalties, and interest qualify for complete 100% discharge. In order for a taxpayer to benefit from bankruptcy laws, it is important to get expert tax help to determine whether or not your tax liabilities are eligible for discharge.

In October 2005, Congress enacted the Consumer Bankruptcy Law – including big changes that affect the ability to discharge income taxes. Therefore, it is highly recommended that the taxpayer seek out experienced legal counsel that specializes in tax bankruptcy.

Brian gave Russ and Sully the lowdown on bankruptcy and tax debt. You can start by becoming familiar with how bankruptcy and IRS back taxes work:

  • Talk to a tax attorney or Certified Tax Resolution Services about the differences between Chapter 7, Chapter 13 and Chapter 11 bankruptcies. Chapter 7 is what everyone wants. Chapter 7 is forgiveness, wiping out everything.
  • The results of filing for Chapter 7 generally go two ways. “Discharged” means the bankruptcy went through and you’re forgiven. The other term is “dismissed” which means you filed a bankruptcy petition and the judge finds that you don’t have the appropriate financial situation to grant you forgiveness for discharge.
  • If Chapter 7 isn’t possible, you can then submit a petition for a Chapter 13. A Chapter 13 is basically a structured payment plan called a Wage Earner Plan.

Expert Tax Help: Don’t Pay A Cent More Than You Need By Knowing Which Deductions to Claim

Are you paying more to Uncle Sam than you need to be?

Surely no one wants to give the IRS extra cash that would otherwise stay in their own pockets. My partner Brian Compton recently shared some expert tax help tips on the Big Biz Show on how taxpayers can minimize their tax bill this year by taking full advantage of their allowable tax deductions.

Below are some top tax deductions taxpayers should not miss:

1. First-Time Homebuyer Credit

For those of you who did not own a home or residence within the last 3 years and purchased one in 2009, you can claim up to $8,000 or 10% of $80,000 of the purchasing price in tax deductions this coming April.

But be careful–this does not apply to people who bought homes before 2009; so it’s not a tax credit for anyone who’s purchased a home for the first time within the last three years. Erroneously claiming this credit when you don’t qualify could result in IRS penalties and interest. Also, if you sold your home within the last 3 years and purchased a new one in 2009, it still disqualifies you for this credit. It’s important to remember that this is for people who were not homeowners in the last 3 years before they purchased one in 2009!

2. Payroll Tax Deductions

If you are an employee for a business, make sure that your employer has given you the benefit of the payroll tax deduction. This payroll tax deduction reduces your tax withholding by $400 if you’re single and $800 if you’re married. In other words, this payroll tax will reduce your income by 6%–which can make a difference in the tax payment you owe.

3. $250,000 in Business Deductions For Equipment

Section 179 allows businesses to purchase equipment for normal operations up to $250,000 and expense all of it. As opposed to deferring your business expense deductions over the course of many years to come, Section 179 allows businesses to reduce their tax bill by $60,000 to $70,000 in this year alone.

4. Sales Tax on Vehicle Purchases

If you’ve purchased a vehicle any time between February 2009 and early 2010, you will be able claim the sales tax on your car up to $50,000 of a vehicle cost. Keep a good record of your major purchases to ensure that you get the tax deduction you deserve.

5. Charitable Donations

While there is no limit to how much you can deduct for your charitable donations, you need to know that large amounts of deductions will wave a red flag to the IRS. The IRS special code 501C-3 typically includes churches and schools, which means you can write a check for whatever amount you wish and it will be accepted as long as it is proved to be legitimate (i.e. cashed by the organization.)

Note: Always keep your checks and receipts. You never know if/when the IRS will audit you and you do not want to be caught in a position where your truthful deductions are not accepted based on a lack of proper documentation.

A Certified Tax Resolution Specialist has a track record of success with the IRS. You get that success rate by negotiating realistic Offers in Compromise with the IRS. An IRS tax relief scam might give you an impressive number of Offers In Compromise they have filed, but the number of OICs a tax resolution firm files is not what matters. IRS Payment Plans: A Better Option for Tax Relief Than Filing False Tax Returns With the Aid of Your Pastor

A religious leader in Vancouver, Wash., was sentenced to five months in prison for aiding the preparation of a false tax return.  

Until last September, Maximo Garza, 47, was the pastor for Victory Outreach Church of Portland, a non-denominational church which has operated in Portland, Ore., for more than 15 years.

During his plea hearing, Garza admitted he provided false expense invoices which purported to reflect public relations and other services provided by Victory Outreach Church to William Thompson, who was then operating a mail-order divorce service using the name Hallwood Inc. Thompson used the false invoices to take expense deductions on tax returns filed by Hallwood in order to fraudulently reduce his tax liability.

Between 2001 and 2003, Garza provided invoices reflecting a total of $735,441 in false business expenses. Thompson agreed to let Garza keep approximately 10% of the expense amounts.

Thompson pled guilty to tax evasion and was sentenced to a prison term in 2007.

A former Department of Defense contractor was arrested in Fort Worth, Texas, by IRS Special Agents without incident on federal charges that he filed fraudulent tax returns in excess of $575,000.

The indictment by a Tucson, Ariz., grand jury alleges Michael T. McQuillen, 49, of Saginaw, Texas, and formerly of Tucson — and who been primarily employed with various contractors for the United States Department of Defense — filed eight U.S. Individual Income Tax Returns claiming tax refunds in excess of $575,000.

It alleges McQuillen attached Forms 1099-OID (Official Issue of Discount) to seven of these returns which falsely claimed withholding of federal individual income taxes approximately equal to the amount of earned income. The indictment alleges McQuillen received actual refunds from two of the fraudulent tax returns totaling $155,986.

He faces up to five years in prison and a $250,000 fine.

A New Hampshire businessman pleaded guilty to attempting to evade payroll taxes in connection with the operation of a contracting business he owned.

Richard H. Taylor, of Weare, N.H., owned and operated R.H. Taylor Drywall, LLC, a construction management company based in Goffstown, N.H. From about April 1, 2004, to July 31, 2004, under Taylor’s direction and supervision, the company paid many of its employees’ wages in cash but did not withhold federal income taxes and Federal Insurance Contribution Act taxes from the cash wages and did not report the payment of those wages to the IRS. Taylor’s conduct resulted in a tax loss to the United States of about $109,000.

He faces up to five years in prison and a fine of up to $250,000.
