QUESTION: If the IRS has a current tax lien on one’s property and the lien does not expire until 2010, by what authority can they refile the lien more than a year prior to its expiration? There are now two liens for the same amount of money on the same property. Is this possible?
In addition, one of the liens expired on 1/10/09. The IRS reissued the lien on 4/15/09. Is this possible?

ANSWER: The IRS, under Internal Revenue Code Section 6325, has 30 days before the expiration of the original tax lien to re-file a new lien but almost never does. The IRS, if they wanted to, can also reduce the lien to a judgment (lawsuit) and add another 20 years to the statute to collect on this debt. An IRS lien attaches to ALL personal and real property that the taxpayer currently owns and acquires in the future while the lien is in effect. The matter you described in your question warrants a Tax Transcript and Record of Account investigation to determine just exactly what is going on.
